SpeedyRecord Terms of Service
Effective date: [EFFECTIVE DATE]
Last updated: [DATE]
These Terms of Service ("Terms") are a binding agreement between you and MyAiGuidanceCounselor LLC, a North Carolina limited liability company ("SpeedyRecord," "we," "us," or "our") governing your use of speedyrecord.com and app.speedyrecord.com (together, the "Service"). By creating an account, starting a trial, subscribing, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. What SpeedyRecord is
SpeedyRecord is a software tool that helps parents and guardians organize homeschool records — logging subjects and hours, tracking attendance, generating transcripts, and preparing informational forms and checklists related to state homeschooling requirements. SpeedyRecord is a recordkeeping and organizing tool. It is not a law firm, does not provide legal advice, and is not a substitute for the advice of a qualified attorney or for guidance from your state or local education authority. See Section 7.
2. Eligibility
You must be at least 18 years old and the parent or legal guardian of the student(s) whose records you maintain, or otherwise legally authorized to maintain them. By using the Service you represent that you meet these requirements.
You are the legal administrator of your home education program. SpeedyRecord is a tool you use; it does not administer your program, and it does not assume any of your legal duties as the parent, guardian, or administrator.
3. Your account, PIN, and your data
a. Local storage. The Service stores your student records locally on your device in encrypted form, using a key derived from a PIN you choose. As described in our Privacy Policy, we do not store your records or your PIN on our servers.
b. No PIN recovery. We cannot recover your PIN or your records if you forget your PIN. You are responsible for remembering your PIN and for maintaining your own backups. We are not responsible for any loss of records resulting from a forgotten PIN, a lost or reset device, cleared browser data, or your failure to back up.
c. Your responsibility. You are responsible for the accuracy of the information you enter and for maintaining the confidentiality of your device and PIN.
4. Subscriptions, trials, and billing
a. Free trial. We offer a 14-day free trial, and no payment method is required to start it. The trial does not automatically convert into a paid subscription and you will not be charged when it ends. To continue using the Service after the trial, you must choose a plan and provide payment. [CONFIRM: this reflects the "no card required" promise on the marketing site. If the trial is instead card-required and auto-converts, this section must be rewritten and an auto-renewal disclosure added.]
b. Subscriptions and auto-renewal. Paid subscriptions are billed on a recurring basis (monthly or annually, as selected) through our payment processor, Stripe. Your subscription automatically renews at the end of each billing period at the then-current price unless you cancel before the renewal date.
c. Founding-family pricing. If you subscribe during our founding-family period, the subscription rate in effect when you start remains your rate for as long as your subscription stays continuously active. If your subscription lapses or is cancelled, founding-family pricing may no longer be available and the then-current rate will apply upon resubscription.
d. Price changes. We may change prices. For existing subscribers, we will provide advance notice of at least 30 days before a price change takes effect, and any change applies to the next billing period.
e. Cancellation. You may cancel at any time through the App or by contacting us. Cancellation stops future renewals; you retain access through the end of the current paid period.
f. Refunds. Except where required by law, payments are non-refundable. You may cancel at any time; cancelling stops future charges but does not refund amounts already paid for the current billing period, and you retain access through the end of that period.
g. Taxes. Prices may not include applicable taxes, which you are responsible for where required.
5. Access codes and promotional offers
We may issue promotional or free-access codes. [Describe: codes are for the intended recipient, may be limited in time or scope, cannot be resold or transferred unless stated, and may be revoked for misuse.] We may modify or discontinue promotions at any time.
6. Acceptable use
You agree not to: use the Service for any unlawful purpose; attempt to access, decrypt, or interfere with data that is not yours; reverse engineer, resell, or redistribute the Service except as allowed by law; disrupt or compromise the security or integrity of the Service; or use the Service to violate the rights of others.
7. Compliance content is informational — not legal advice (please read)
SpeedyRecord provides checklists, deadline reminders, form templates, and summaries relating to state homeschooling requirements (collectively, "Compliance Content"). Compliance Content is provided for general informational and organizational purposes only and does not constitute legal advice.
- Homeschool laws vary by state and locality and change over time. Compliance Content may not reflect the most current requirements, and requirements may differ for your specific circumstances.
- You are solely responsible for determining and satisfying the requirements that apply to you, including confirming current rules, deadlines, recipients, and forms with your state or local education authority or a qualified professional.
- Forms and templates are starting points that you must review and verify before relying on or submitting them. SpeedyRecord does not file anything with any government agency on your behalf, and does not guarantee that any form will be accepted or that using the Service will result in compliance.
- To the fullest extent permitted by law, SpeedyRecord is not responsible for any consequence arising from reliance on Compliance Content, including missed deadlines, rejected filings, penalties, or determinations of non-compliance.
Assumption of risk. You understand that failing to meet your state's or locality's home education requirements can carry serious consequences, which may include truancy proceedings, educational-neglect proceedings, or other legal action against you. You knowingly assume all risk arising from your own compliance decisions, and you release SpeedyRecord from any liability for such consequences, to the fullest extent permitted by law.
8. AI-assisted features — accuracy and your required review
The Service may offer AI-assisted features (for example, generated course descriptions, grading or transcript language, or an "AI Guidance Counselor"). By using them, you acknowledge and agree that:
- AI output is probabilistic and can be wrong. It may contain factual errors, structural inaccuracies, or fabricated content ("hallucinations").
- The AI is not a professional. It is not a licensed educator, guidance counselor, evaluator, registrar, or state curriculum auditor, and it does not provide legal or educational advice.
- You must review and approve AI output before you rely on it. You are required to review, edit, and manually authorize any AI-generated descriptions, grades, transcript details, or other content before submitting it to any school, district, evaluator, or government agency. You are solely responsible for the accuracy of anything you submit.
- AI runs on your device. AI-assisted features are implemented as embedded, on-device models; your records are not transmitted to an outside AI provider (see our Privacy Policy).
9. Intellectual property and your license
The Service, including its software, design, text, and templates, is owned by SpeedyRecord or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, household homeschooling use, subject to these Terms. The records you create remain yours; these Terms do not claim ownership of your content.
10. Third-party services
The Service relies on or interoperates with third parties, including Stripe (payments) and, if you enable it, Google Drive (optional backup). Your use of those services is governed by their terms and privacy policies, and we are not responsible for third-party services.
11. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT COMPLIANCE CONTENT IS CURRENT, COMPLETE, OR ACCURATE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SPEEDYRECORD AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, RECORDS, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, INCLUDING ANY RELIANCE ON COMPLIANCE CONTENT OR ANY LOSS OF RECORDS DUE TO A FORGOTTEN PIN OR LACK OF BACKUP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR (B) FIFTY U.S. DOLLARS ($50). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
13. Indemnification
You agree to indemnify and hold harmless SpeedyRecord and its owners, employees, and agents from any claims, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, your violation of these Terms, or your violation of any law or third-party right.
14. Termination
You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. Provisions that by their nature should survive termination (including Sections 7, 8, 9, 11, 12, 13, and 15) will survive.
15. Governing law and dispute resolution
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. You and SpeedyRecord agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in North Carolina, and you consent to the personal jurisdiction and venue of those courts.
[NOTE FOR COUNSEL: the company intends to move to binding individual arbitration with a class-action waiver at a later date. Please advise on drafting and on how to give existing users proper notice of that change when it happens.]
16. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Service after an update means you accept the revised Terms.

Items to complete before publishing
[CONTACT EMAIL]— the address you'll monitor.[EFFECTIVE DATE]/[DATE]— set to your publish date.- Confirm the free-trial mechanics (Section 4a): the marketing site says "no card required," which means the trial cannot auto-charge. If that's wrong, Section 4a must be rewritten with a proper auto-renewal disclosure.
- No physical address is listed (home address withheld). Counsel to confirm acceptable.
- Counsel to confirm the all-caps warranty disclaimer and liability limitation meet North Carolina's conspicuousness/enforceability standards, and that the $50/12-months cap is enforceable as drafted.
- Counsel to advise on the planned future move to binding arbitration + class-action waiver (Section 14), including notice to existing users.
- Entity note: SpeedyRecord is operated by MyAiGuidanceCounselor LLC. Classical Learner Homeschool Company is a sister company under common majority ownership (Brett Pike). Counsel to confirm users are clearly told which entity they contract with.
- AI features: the company commits that AI-assisted features run as embedded, on-device models with no outbound calls. If that ever changes to a cloud/third-party AI provider, these Terms, the Privacy Policy, and the marketing claims must be updated before shipping.
